Guide to Buying a House in Spain: Everything You Need to Know

Thinking of buying a house in Spain? Are you worried about the complexity of the procedures you will have to face during the purchase process? This guide for foreigners will provide you with all the information you need to make a safe purchase.

Buying a property in Spain as a foreigner may seem complicated, but with the right guidance, the process becomes transparent. Here is a list to help you understand the essential procedures:

  • Required Documentation: Prepare your passport and apply for your NIE (Foreigner Identification Number). You also have to open a bank account in Spain.
  • Property Selection: Explore the wide range of properties in the most sought-after locations in Spain.
  • Purchase Agreement: Once you find the house of your dreams, reach an agreement with the seller on the price and conditions of sale.
  • Deposit Contract: This price and conditions of sale are written in the deposit contract, which is signed by both parties and a amount is paid as a deposit to secure the property.
  • Deed of Sale: The deed of sale drawn up by a notary is signed and the full payment is made.
  • Property Registration: The property is registered in your name in the Spanish Property Registry.
  • Taxes: The taxes that have to be paid for buying a property in Spain depend on whether it is a new or second-hand property, and on the autonomous community where the property is located.

- If you buy a new property directly from a developer, you will have to pay two taxes:

o Value Added Tax (IVA), which is 10% of the sale price.

o Stamp Duty (AJD), which varies according to the autonomous community, but usually ranges between 0.5% and 1.5% of the sale price.

- If you buy a second-hand property, you will have to pay only one tax:

o Transfer Tax (ITP), which also depends on the autonomous community, but usually ranges between 6% and 10% of the sale price.

In addition to these taxes, you will also have to bear other expenses associated with the purchase, such as notary, registry, management and valuation fees. These expenses can amount to between 10% and 12% of the price of the property.
